6Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described therein.

You retain ownership of your data. We claim no intellectual property rights over the content you upload to the Service.

6.1 SMS Communications

When you provide a mobile number on a Exoserva-powered contractor's booking page and tick the SMS consent checkbox — or grant verbal consent recorded by a technician — you receive transactional service SMS (appointment confirmations, technician ETA, estimates, invoices, payment receipts) from that contractor, sent via the Exoserva platform. No marketing or promotional content is sent under the currently registered campaign.

Message frequency varies with service activity. Message and data rates may apply. Mobile information and messaging consent are not shared with third parties or affiliates for marketing or promotional purposes. Reply STOP to any message to unsubscribe, or HELP for assistance.

See the public consent reference at exoserva.com/sms-opt-in-example and our Privacy Policy for full details on how SMS data is handled.

7SMS Messaging

Exoserva operates an SMS messaging programme on behalf of contractors using the Service. The programme is registered with The Campaign Registry (TCR) as a Customer Care (transactional) A2P 10DLC campaign and sends only transactional service messages: appointment confirmations, technician ETA, estimates, invoices, and payment receipts. No marketing or promotional content is sent under this campaign.

Recipients may opt in via the contractor's booking page, by verbal consent captured by staff, or via the in-app preferences page. Opt-out keywords STOP and HELP are honoured immediately per CTIA carrier rules. Standard message and data rates may apply.

Full details of the programme — including categories, message frequency, opt-in methods, opt-out keywords, vendor disclosure, and privacy commitments — are published in our SMS Messaging Terms, which are incorporated into these Terms by reference. A live demonstration of the opt-in user experience is available at /sms-opt-in-example.

8AI Features and Limitations

The Service includes AI-powered features. You acknowledge that:

  • AI outputs may contain errors and should be reviewed
  • AI is a tool to assist, not replace, human judgment
  • Usage limits apply to AI features based on your tier
  • AI features may be updated or modified without notice

9Intellectual Property

9.1 Ownership: The Service and everything we provide through it — including the software, web and mobile applications, source and object code, designs and user interfaces, AI prompts, agents, models and their configurations, templates, documentation, and the Exoserva name, logos and other trademarks — are owned by Knock Knock Contractor LLC and its licensors and are protected by copyright, trademark, trade secret and other intellectual property laws. Except for the limited right granted in Section 9.2, these Terms do not transfer to you any right, title or interest in the Service.

9.2 Your Right to Use the Service: Subject to these Terms and payment of the applicable fees, Knock Knock Contractor LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Service during your free trial or subscription term, solely for your internal business purposes. Your authorized users may exercise this right on your behalf, and you are responsible for their compliance with these Terms. This right ends when your trial or subscription ends or when these Terms are terminated, except that you may continue to access the Service to export Your Content during the period Section 11 allows. If you use the Service only through a business's customer-facing features (such as its booking pages, estimates, invoices, or customer portal), you may use those features for their intended purpose, and Sections 9.1, 9.3, and 9.9 apply to that use.

9.3 Restrictions: Except as these Terms expressly allow or as applicable law permits notwithstanding this limitation, you must not, and must not permit or help anyone else to:

  • Copy, modify, translate, or create derivative works of the Service or any part of it
  • Reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code, models, prompts, underlying structure, or algorithms of the Service
  • Scrape, crawl, harvest, or use bots or other automated means to extract data or content from the Service, except through the APIs and integrations we make available to you and within their documented limits
  • Frame, mirror, or embed any part of the Service on another website or service, except through features we provide for that purpose
  • Sell, resell, rent, lease, sublicense, or otherwise provide the Service to third parties, or operate it as a service bureau, except that your own customers may use the customer-facing features the Service provides for them
  • Remove, alter, or obscure any copyright, trademark, or other proprietary or license notice in or on the Service
  • Use the Service, or any output, data, or content obtained from it, to build, train, fine-tune, or improve a product or service that competes with the Service, including any AI model, or to copy its features, functions, designs, or prompts
  • Probe, scan, or test the vulnerability of the Service, or breach or circumvent any security, authentication, or rate-limiting measure, except good-faith security research conducted and reported under our Vulnerability Disclosure policy

Our Acceptable Use Policy, which forms part of these Terms, sets out further prohibited uses.

9.4 Your Content: As stated in Section 6, you retain ownership of your data, and we claim no intellectual property rights over the content you upload to the Service ("Your Content"). You grant Knock Knock Contractor LLC a limited, non-exclusive, royalty-free right to host, store, copy, process, transmit, and display Your Content to provide, maintain, secure, support, and improve the Service, and otherwise as described in our Privacy Policy. We may use de-identified, aggregated data derived from use of the Service to operate and improve it, and we do not use your proprietary business data to train foundation AI models that serve other customers. Estimates, invoices, messages, and other materials the Service produces from Your Content are yours to use in your business, subject to these Terms; they do not give you any right in the Service itself, including the prompts, agents, models, and templates that produced them. You are responsible for having the rights needed to upload Your Content.

9.5 Feedback: If you send us suggestions, ideas, enhancement requests, or other feedback about the Service, you grant Knock Knock Contractor LLC a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to use, modify, and incorporate that feedback into the Service or otherwise exploit it, without any obligation or compensation to you. Feedback does not include Your Content.

9.6 Third-Party and Open-Source Components: The Service includes software and content licensed from third parties, including open-source software. Those components are governed by their own license terms. Nothing in these Terms limits any right you have under an open-source license, and where such a license grants you rights these Terms would otherwise restrict, that license governs your use of that component. The notices for these components are listed on our Open-Source Notices page. To request source code that an open-source license requires us to make available, contact us at contact@exoserva.com. Third-party services you connect to the Service are governed by their providers' terms.

9.7 Trademarks: Exoserva, the Exoserva logo, and our other product names and logos are trademarks of Knock Knock Contractor LLC. You may not use them without our prior written permission, except to identify the Service accurately. Third-party trademarks shown in the Service belong to their respective owners.

9.8 Copyright Complaints: We respect the intellectual property rights of others. If you believe material available through the Service infringes your copyright, follow the notice procedure in our DMCA / Copyright Policy.

9.9 Reservation of Rights: All rights not expressly granted to you in these Terms are reserved by Knock Knock Contractor LLC and its licensors, and no license is granted by implication, estoppel, or otherwise. A breach of Section 9.3 is a material breach of these Terms: we may suspend or terminate your access under Section 11 and seek injunctive or other equitable relief, which Section 13 leaves outside arbitration.

10Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Knock Knock Contractor LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service will cease immediately. You may export your data within 30 days of termination.

12Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service constitutes acceptance of the modified Terms.

13Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. The federal and state courts located in Travis County, Texas have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except as provided in the arbitration clause below.

Binding Arbitration. Except for claims for injunctive or equitable relief, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in Travis County, Texas, in English, and the arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

Class Action Waiver. You and Knock Knock Contractor LLC each agree to bring disputes only in an individual capacity and not as a plaintiff or class member in any purported class or representative action. Class arbitrations and class actions are not permitted.

This section is a Plain-English summary of standard governing-law terms and does not constitute legal advice. Enterprise customers entering custom Master Service Agreements should review jurisdictional fit with counsel before signing.
