Acceptable Use Policy

What you can and can't do with the Exoserva platform, how we enforce these rules, and how to report violations.

1. Overview

This Acceptable Use Policy (AUP) is incorporated into the Terms of Service by reference and applies to every user, tenant, and integration that touches the Exoserva platform. The summary at ToS §5 is a quick reference; the full list below is the canonical version.

2. Prohibited Uses

You must not use the Service to:

2.1 Illegal or harmful activity

  • Violate any law, regulation, court order, or industry-specific licensing requirement.
  • Infringe intellectual property rights, including copyright, trademark, patent, or trade-secret rights.
  • Defame, harass, threaten, dox, or impersonate any person or business.
  • Engage in human trafficking, sexual exploitation, child sexual abuse material, or content sexualising minors.

2.2 Security and integrity

  • Transmit malware, ransomware, worms, or any code intended to disrupt or surveil systems.
  • Probe, scan, or test platform vulnerabilities without written authorization (responsible disclosure: security@exoserva.com).
  • Interfere with the Service, attempt unauthorized access, or bypass authentication / rate limits.
  • Use automated systems (bots, scrapers, headless browsers) without prior written permission.

2.3 Content and conduct

  • Upload or transmit content that is fraudulent, deceptive, or designed to phish.
  • Promote firearms, ammunition, controlled substances (cannabis included where federally regulated), gambling without proper licensing, multi-level marketing, or high-risk financial products restricted by carrier policy.
  • Operate in industries explicitly disallowed by carrier or registry policy without written exemption (loan modification, debt forgiveness, get-rich-quick schemes, S.H.A.F.T. content).

2.4 Resource abuse

  • Exceed AI usage limits applicable to your subscription tier.
  • Resell or sublicense the Service without explicit written authorization.
  • Use the Service primarily as storage / CDN for content unrelated to field-service operations.

3. SMS-Specific Restrictions

Carrier and registry rules (CTIA, TCR, T-Mobile, AT&T, Verizon) apply on top of this AUP. See the full programme detail in our SMS Messaging Terms. Headline restrictions:

  • Send SMS only to recipients who have given prior express written consent. Pre-checked consent boxes are not consent.
  • Honour STOP, STOP MARKETING, and HELP keywords on every message.
  • Do not send messages relating to the "S.H.A.F.T." categories (sex, hate, alcohol, firearms, tobacco) outside age-gated, licensed contexts.
  • Do not bulk-send to lists you did not collect consent for; importing third-party lists is grounds for immediate termination.

4. Voice AI Restrictions

  • Voice AI must identify itself as an automated assistant when the recipient asks "is this a robot?" or equivalent.
  • Outbound voice calls must comply with TCPA, including time-of-day restrictions and Do-Not-Call list scrubbing.
  • Recording is permitted only with caller notification per state-specific consent rules (one-party vs two-party).
  • You must not use Voice AI to impersonate a specific person without their written authorization.

5. Enforcement

When we detect or are notified of a violation, we may, at our sole discretion and proportionate to severity:

  1. Notify the account owner with a description of the violation and a window to remediate (typically 7 days).
  2. Throttle or suspend the offending feature (e.g. SMS sending) while the account remains active.
  3. Suspend the entire account pending investigation if the violation is high-severity (illegal content, security probe, mass spam).
  4. Terminate the account with cause. No refund is owed for accounts terminated for AUP violations (see Refund Policy §5).
  5. Report to law enforcement, registry (TCR), carrier, or affected third parties when required by law or carrier rules.

We update this policy as carrier, registry, and regulatory rules evolve. Material changes (additional prohibited categories, stricter enforcement, etc.) are announced at least 30 days in advance via email and in-app notification.
